1. Regulatory Compliance (RERA)
All projects and properties offered by OPG Realty (the "Group") are subject to and shall comply with the Real Estate (Regulation and Development) Act, 2016 (“RERA”) along with the applicable Rajasthan RERA Rules. Wherever the statute makes registration mandatory, only registered projects shall be promoted, marketed, or sold.
Buyers/Allottees are encouraged to independently verify the project's RERA registration number, sanctioned plans, approvals, and other disclosures published on the official RERA portal before executing the Agreement for Sale. The Group is available to facilitate this verification.
2. Booking and Payments
The booking amount for any property shall not exceed 10% of the total consideration until the Agreement for Sale is executed, in accordance with Section 13 of RERA. No demand for a higher upfront advance will be made or accepted.
All payments must be made via Cheque, Demand Draft (DD), or Bank Transfer to the Group’s officially designated bank accounts. Any cash payments, if accepted, shall remain within the statutory limits prescribed by applicable tax and anti-money laundering laws.
Timely payment of installments linked to construction milestones is essential. Delayed payments may attract interest at the rate permitted under RERA or as mentioned in the Agreement for Sale. Persistent default can result in cancellation of the allotment after issuing the requisite notices.
3. Property Specifications and Area
The final area handed over to the Buyer/Allottee shall be the Carpet Area as defined under RERA. Any variation in the Carpet Area, if within the permissible limits set by law, will be adjusted in the final payable amount (either by refund or additional demand).
While every effort is made to deliver the specifications and amenities as showcased, the Group reserves the right to make alterations required by regulatory authorities, structural consultants, or site conditions, provided such changes do not materially diminish the promised quality or utility.
4. Intellectual Property Rights
4.1. Ownership: All content, features, and functionality of our Services, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are owned by OPG Realty or its licensors and are protected by intellectual property laws.
4.2. Limited License: We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use our Services for personal, non-commercial purposes.
4.3. Restrictions: You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any content from our Services without our prior written consent.
5. Limitation of Liability
5.1. Disclaimer: Our Services are provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
5.2. Limitation: In no event shall OPG Realty, its affiliates, or their respective directors, officers, employees, agents, or partners be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our Services.
6. Modifications
We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting the updated Terms on our website. Your continued use of our Services after any such changes constitutes your acceptance of the modified Terms.
7. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.
